Don't make earthly pressed peanut oil a local specialty

Earthpressed peanut oil is often regarded as "pure natural" healthy edible oil, which makes many consumers like to buy, and some also regard it as a famous "local specialty" donator, but some of them often have aflatoxin B1 exceeding the standard. Earlier, the court of Zijin County, Heyuan City, concluded a case in which the operator was sentenced to a penalty for producing and selling peanut oil that did not meet safety standards. The owner of the oil factory was sentenced to six months'imprisonment and a fine of 5,000 yuan.

Since 2014, Zou has managed Yufeng Oil Workshop in Zijin County, purchasing peanuts for peanut oil processing and marketing. On November 19 of the same year, the Zijin Food and Drug Administration sent a sample of 1 kg to Heyuan City, Guangdong Province, for inspection. The results showed that aflatoxin B1 was not up to standard. Accordingly, the Food and Drug Administration of Zijin County, in accordance with the provisions of the Food Safety Law of the People's Republic of China, imposed a fine of RMB 2000 on Zou Mou on January 28, 2015. On March 31 of the same year, the Food and Drug Administration of Zijin County again sampled peanut oil from Yufeng Oil Workshop according to law. The result showed that the value of aflatoxin B1 was over 20, which was unqualified. On June 4 of the same year, the Food and Drug Administration of Zijin County transferred the food crime suspected of producing unsafe food to the Zijin County Public Security Bureau for investigation, and Zou Mou, the boss, was detained by the public security organ according to law.


After trial, the Zijin County Court held that Zou Mou, the defendant, ignored the national law and produced and sold food sufficient to cause serious foodborne diseases. His actions constituted the crime of producing and selling food that did not meet the safety standards, and should be punished according to law. Then a first-instance judgment was made according to law: the defendant Zou Mou was convicted of the crime of producing and selling food that did not meet the safety standards. He was sentenced to six months'imprisonment and a fine of RMB 5000.

The crime of producing and selling food that does not meet the safety standards is both a consequential crime and an act crime. As long as the facts of the crime are enough to cause serious foodborne diseases, it can constitute the crime.


The processing technology of some small workshop peanut oil plants is simple. Usually there are only four processes of peanut shelling, heating and baking, pressing oil, filtering and precipitation. It is difficult to filter out mildewed peanuts in the process of processing, lack of finishing and inspection, and it is difficult to meet the national safety standard of edible oil. Aflatoxin B1 is easy to exceed the standard. Like, some even exceed the standard several times. Aflatoxin B1 is a primary carcinogen, which can destroy human liver tissue and lead to liver cancer and even death.


The Regulations on the Administration of Small Food Production and Processing Workshops and Food Vendors in Guangdong Province were implemented on October 1, 2015, in synchronization with the newly revised Food Safety Law of the People's Republic of China. Article 14 of the Regulation clearly prohibits small food workshops from producing and processing edible oils such as crushed peanut oil that do not meet food safety standards. If the workshop produces extruded peanut oil that does not meet the food safety standards, it will confiscate the illegal income, food and production equipment, etc. If the production value exceeds 10,000 yuan, the amount of fines will also increase from 3 to 5 times of the previous value to 10 to 20 times. If the crime is constituted, it will be pursued according to law. To investigate criminal responsibility.


The case-handling judge reminded the general public that food safety awareness should be raised and rational consumption should be made. When purchasing extruded peanut oil, it is necessary to carefully check whether there is a legal registration certificate in the small workshop, and to purchase reassuring products that meet the safety and hygiene standards of edible oil after strict inspection.
